Customers booking a city tour are hereinafter referred to as "Client".
The tour guide who conducts the booked city tour on-site is hereinafter referred to as the "Guide".
All city tours are offered and provided on the basis of these General Terms and Conditions.
Booking
Booking a city tour becomes binding upon receipt of the booking confirmation via email from the Provider and is based on prior agreement with the Client (by phone or email). The booking is to be understood as a binding declaration of intent by the Client. Any changes to a binding booking are also recorded exclusively in writing or via email. City tours are subject to a maximum number of participants per guide, which is specified in the booking confirmation. If the desired group size exceeds the maximum number of participants, this must be agreed upon in advance. Upon agreement, an increase in the number of participants with an additional fee may be possible, and it may be necessary to book an additional guide and divide the group.
Execution
The city tour is conducted by a qualified guide. The selection is made by the Provider based on the qualifications required for the city tour. The Client has no entitlement to the provision of a specific guide. Even in the event of naming a specific guide, the Provider reserves the right to replace them with another suitable guide in case of compelling reasons for hindrance. The Provider is entitled to adjust the booked city tour to changed conditions (such as group size or opening hours of the visited sites). If admission fees arise as part of a city tour (e.g., for the Maintower or the Kaisersaal), these must be paid separately in cash by the Client on-site unless expressly agreed otherwise in advance and stated in the booking confirmation. Agreed interior visits will be conducted whenever possible. If rooms are not publicly accessible at the time of the city tour, there is no entitlement to an interior visit. The Guide will adapt the city tour as best as possible at short notice, depending on the circumstances. Due to possible waiting times or short-term closures at certain institutions (e.g., Maintower or Kaisersaal), the Provider cannot ensure that the Guide accompanies the group during the visit within the duration of the city tour.
Prices and Payments
The offered price includes individual consultation, booking, and the city tour. If additional services are desired by the Client (e.g., covering the cost of tastings or purchasing tickets), this service will be separately agreed upon and charged.
It is expressly stated that internal booking processes of the Client, which are not legally necessary and provided for, must be separately paid (e.g., individual forms to be filled out by the Provider). This additional effort will be invoiced additionally depending on the effort.
The specific payment terms are stated in the booking confirmation.
Cancellation by the Provider
The Provider reserves the right to cancel the appointment only in the event of sudden illness of the guide, inclement weather, or other force majeure. The Client can choose to receive a refund of any fees already paid or to arrange an alternative date. The Provider endeavors to find an adequate replacement for a sick guide. Further claims for compensation are excluded. The Guide is entitled to terminate the tour if one or more participants of the group are intoxicated or for other reasons, the safe conduct of the event is not guaranteed. In this case, the entitlement to payment of the fee in full remains.
Cancellation by the Client
The conditions can be found in your offer, and these apply in any case of cancellation. The only exceptions are an official weather warning for the Frankfurt city center from the German Weather Service or a ban on city tours from an official authority. As long as city tours are allowed to be conducted in Frankfurt, you can rely on your tour, and the agreement applies. A confirmed order can only be canceled in writing, and cancellation costs incurred will be invoiced to the Client. The agreed fee is due in full even if the group does not appear for a booked tour.
Rescheduling
A change of the booked date (day or time) requested by the Client is only possible in coordination with the Provider and requires their consent. A short-term rescheduling is generally treated as a cancellation and rebooking. The cancellation conditions of the booking confirmation apply. We will gladly try to accommodate your wishes as long as the scheduled guide is available. However, there is no entitlement to this.
Audio and Visual Recordings
are only possible with prior agreement and explicit permission from the Guide.
Delays
In case of delay of the group to be led, the city tour is shortened by the duration of the waiting time; there is no entitlement to an extension or reduction of the price. An extension of the city tour on-site is only possible if the Guide can arrange it timewise and only in consultation with the Provider by the Client. In the event of an extension, the payable working time consists of the waiting time of the tour guide and the actual duration of the tour. The agreed fee increases proportionately. In case of delay of the Guide, the city tour is extended by the delayed time in consultation with the group free of charge.
Upon booking, each Client will be asked for a contact person on-site as well as a mobile number. If the group does not appear at the meeting point at the booked time and cannot be reached by phone, the Guide will wait there for 30 minutes. After that, there is no further entitlement to the booked service, and the Guide leaves the meeting point. The fee is still due in full.
Liability
Participation in the city tours is at your own risk. The liability of the Provider is limited to the fulfillment of the agreed scope of services and is financially limited to the amount of the agreed guiding fee.
Supervision Duty
In city tours with children, adolescents, or persons requiring supervision, the Guide does not assume the duty of supervision. This responsibility remains with the Client at all times.
Ineffectiveness
The invalidity of individual provisions of the contract and the terms and conditions does not lead to the invalidity of the entire contract.
Choice of Law and Jurisdiction
Only German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the Client is a merchant, a legal entity under public law, or a special fund under public law, or if they do not have a general place of jurisdiction in the Federal Republic of Germany, Frankfurt am Main is the exclusive – also international – place of jurisdiction for all disputes arising from the business relationship between Verena Röse and the Client.
